About this Policy

Powerhouse Arts, Inc. (“PHA” or “we”) is committed to the privacy and security of personal information.  The purpose of this Privacy Policy (this “Policy”) is to provide you with information about how we collect, use, share, and safeguard certain personal information (“Personal Information”) it gathers.  It also describes options you have concerning your Personal Information that you provide and we collect.  This Policy is part of our Terms of Service. Defined terms that are used but not defined in this Policy have the same meaning given to them in the TOS.  

By accessing our website, our mobile site, and any related websites or webpages (collectively, the “Site”) or using our services, including, without limitation, the use of our Site, registration and attendance at our events, social media interactions, and other communications (the “Services”), you agree that your information may be collected, stored, shared, and used as described in this Policy and the TOS, and you consent to the collection, use and sharing of your Personal Information as outlined in this Policy.  You may withdraw consent at any time in writing, however such withdrawal does not negate our right to process your Personal Information in accordance with this Policy prior to your withdrawal. 

This Policy does not apply to any entity that we do not own or control.  If, at any time during the use of our Services, you are directed to a third-party site, you acknowledge that the policies of the third-party site govern. 

Personal Information We Collect

We collect different categories of information, including the following:

  • Identifiers.  Examples include real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, telephone number, account name, social security number, driver’s license number, or other similar identifiers.
  • Commercial information.  This includes Services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies, as well as bank account numbers and credit card numbers.
  • Education information.  This includes information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, Sec. 1232g; 34 C.F.R. Part 99).
  • Internet or other network activity.  Examples include browsing history, search history, your interaction with our Site, application, or advertisement, and geolocation data.

Use of Personal Information and Reasons for Doing So

Set forth below are the purposes for which we collect your Personal Information:

  • To provide you with information, products or Services that you request from us, and/or to fulfill or meet the reason for which the information is provided (for e.g., fulfilling a shipment); 
  • To provide you with information, event registrations, and other notices concerning our products or Services, that may be of interest to you;
  • To engage in marketing activities, including to help design products and Services appropriate for our users;
  • To carry out our obligations and enforce our rights including those arising from any agreements entered into between you and us, including for billing and payment;
  • To review, improve, and monitor our Site, Services, and overall user experience; to provide customer service and engage in quality control activities concerning our products and Services; and for testing, research, analysis and product and service development, including analyzing interests and demands of our users;
  • To respond to law enforcement requests and as required by applicable law, court order, governmental regulations, or other lawful processes;
  • As additionally described to you when collecting your Personal Information with your prior consent; and
  • As necessary or appropriate to protect the rights, property, security, and safety of PHA, our employees, contractors and agents, our users and consumers, and the public.

Sources of Personal Information

Examples of the sources of Personal Information are described below:

  • You. Examples of when we collect that information include:
    • During a visit to our Site, when you register as a user or you complete a web form, you purchase our products or Services through our Site, and/or when you visit us at one of our location or participate in our events;
  • Tracking tools.  Examples of these include cookies, web beacons and similar technologies.  While your browser may have settings that allow you to decline these technologies, please note that some of our Services may not be available if you do so.
  • Information from Other Sources.  Depending on the use of our Services, we may obtain information or feedback from other users who use our Site.  We may also obtain information about you from third-party partners and third-party service providers.  We may use this information for legitimate business purposes, including the performance of a contract, customer support, fraud prevention, and credit-related decisions in connection with our Services.

Sharing Personal Information with Third Parties

  • Third parties as directed by you.  We will share your Personal Information with those third parties to whom you direct. 
  • Our business partners.  For example, we might share your Personal Information with one of our business partners for purposes of collaborating on providing Services to you, or to invite you to an event we are organizing.  

Aggregated and Non-Personal Information

We may aggregate and/or make anonymous any Personal Information that we have obtained in any way from or about you or others.  We may use and share such aggregated, anonymous or other non-personally identifying information for any legitimate business purposes, including research and development, analytics, marketing, and to inform others about how our Services are engaged with or used. 

Payment Information

If you purchase our products or certain Services, you may need to provide payment information.  We do not intentionally store credit card information entered on our Site.  This information is stored by a third-party payment processor, and the use and storage of this information will be subject to the payment processor’s own terms.  Please note that if you do not wish to provide payment information, you will not be able to use certain Services on our Site.

Do Not Track

While “Do Not Track” is a privacy preference that you can set in your Internet search browser that sends a signal to a website that you do not want the website operator to track certain browsing information about you, because our Site is not configured to detect Do Not Track signals, we are unable to respond to Do Not Track requests.

Our Site and Children

We do not knowingly collect Personal Information from children under 13 years of age. If we obtain knowledge that we have Personal Information about a child under 13, we will endeavor to delete that information.

Security

While we use reasonable measures to protect our Site and your information, no data transmission or data storage can be guaranteed to be completely secure.  Accordingly, we encourage you to use caution when transmitting or providing information to us on-line.

Notice to Site Users Located Outside the U.S.

PHA is headquartered in the U.S.  By accessing our Site or using our Services, we may transfer the Personal Information that we collect from you to a location outside of your jurisdiction, including the U.S.  The data protection laws in these jurisdictions may not provide you with the same protections as those of your jurisdiction.  By accessing our Site or using our Services, you acknowledge that these applicable laws may provide a different standard of protection, and you consent to the transfer to, and processing of your Personal Information in, other jurisdictions, including the U.S.

For example, if you reside in the European Economic Area, in certain circumstances, you have the right to: (i) request access to any Personal Information we hold about you; (ii) obtain without undue delay the rectification of any inaccurate Personal Information; (iii) request that your Personal Information is deleted provided the Personal Information is not required by us for compliance with a legal obligation under applicable law; (iv) prevent or restrict processing of your Personal Information, except to the extent processing is required for the establishment, exercise or defense of legal claims; and (v) request transfer of your Personal Information directly to a third party where this is technically feasible.  

Changes to this Privacy Policy

From time to time, we may revise this Policy.  We will notify you of changes to this Policy by posting an updated version on our Site.
